FAMILY SERVICE AGREEMENT
North Texas Nanny Placement Services
This Family Service Agreement (“Agreement”) is entered into by and between North Texas Nannies (“Agency,” “we,” “us”) and the undersigned client (“Family,” “you”).
By engaging our services, you acknowledge and agree to the terms outlined below.
1. SCOPE OF SERVICES
The Agency provides nanny placement and referral services to families seeking childcare providers. Our services may include, but are not limited to:
Recruiting and interviewing potential nannies
Verifying references and background information as permitted by law
Presenting qualified candidates for family consideration
Coordinating interviews and trial placements
The Agency is not the employer of any nanny. All nannies are employed directly by the Family.
2. TYPES OF PLACEMENTS
The Agency offers the following placement options:
Full-Time Placement (32+ hours per week)
Part-Time Placement (less than 32 hours per week)
Short-Term / Temporary Placement (including seasonal, backup, or contract-based care)
Specific placement details and fees are outlined in your selected service tier or invoice.
3. FEES & PAYMENT
Placement fees are due as outlined in your selected service package.
There is a non-refundable $500 that is charged at the start of any nanny search
Fees are earned upon successful placement and are non-refundable once a nanny begins employment, unless otherwise stated in writing.
Short-term or temporary placements may require payment in advance.
Failure to pay fees may result in suspension of services.
4. GUARANTEE / REPLACEMENT POLICY (IF APPLICABLE)
If included in your service package, the Agency offers a limited replacement period of 30 days in the event the placement ends within the stated guarantee window.
This guarantee:
Applies only to the originally placed position
Does not apply to termination for cause, family relocation, or change in job requirements
Covers replacement assistance only, not fee refunds
5. FAMILY RESPONSIBILITIES
The Family agrees to:
Provide accurate information regarding job duties, schedule, compensation, and household expectations
Comply with all applicable federal, state, and local employment laws
Properly classify the nanny as a household employee (not an independent contractor)
Handle payroll, taxes, workers’ compensation, and insurance
Maintain a safe working environment
6. EMPLOYMENT RELATIONSHIP
The Family is solely responsible for hiring, supervising, compensating, and terminating the nanny.
The Agency does not control daily work, schesdule, or performance.
Any disputes between the Family and nanny are outside the Agency’s control.
7. BACKGROUND CHECKS & DUE DILIGENCE
While the Agency makes reasonable efforts to screen candidates, no guarantee is made regarding a nanny’s performance, conduct, or future behavior.
The Family is encouraged to conduct its own due diligence before hiring.
8. CONFIDENTIALITY
All candidate information is confidential and may not be shared, reproduced, or used outside of the hiring process without written consent from the Agency.
9. LIMITATION OF LIABILITY
To the fullest extent permitted by law:
The Agency shall not be liable for any acts, omissions, or conduct of the nanny.
The Family agrees to hold harmless and indemnify the Agency from any claims arising from the employment relationship.
10. NO CIRCUMVENTION
Families agree not to hire any nanny introduced by the Agency outside of this Agreement for a period of 12 months without payment of the applicable placement fee.
11. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the State of Texas.
12. ENTIRE AGREEMENT
This Agreement represents the entire understanding between the parties and supersedes any prior discussions or representations.

By using our services, you acknowledge that you have read, understood, and agree to the terms of this Agreement.
